1. Acceptance of Terms

By accessing or using SeshHub ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including administrators, operators, and anyone accessing the platform.

2. Description of Service

SeshHub is a browser-based remote terminal access platform. It allows users to deploy agents (Docker containers or ESP32 devices) on remote networks and access terminal sessions through a web interface. The Service includes the web application, SSH gateway, console gateway, and associated APIs.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials, including passwords and MFA tokens.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Access systems or networks without proper authorization.
• Violate any applicable laws, regulations, or third-party rights.
• Distribute malware, viruses, or other harmful code through terminal sessions.
• Attempt to bypass security measures, authentication mechanisms, or access controls.
• Use the Service for any illegal activity, including unauthorized access to computer systems.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service.

5. Agent Deployment

You are solely responsible for ensuring you have proper authorization to deploy SeshHub agents on any network or system. You must comply with all applicable policies and regulations governing the networks where agents are deployed. SeshHub is not responsible for unauthorized agent deployments.

6. Intellectual Property

The Service, including its software, design, and documentation, is owned by SeshHub and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms. You may not copy, modify, or distribute any part of the Service without prior written consent.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

8. Limitation of Liability

To the maximum extent permitted by law, SeshHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless SeshHub, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may also terminate your account at any time by contacting us. Provisions that by their nature should survive termination will survive, including limitations of liability and indemnification.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved in the courts of competent jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify registered users of material changes via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
